Inquiry Committee Decision Reviews

Under the Health Professions Act, a complainant who is dissatisfied with a decision of the Inquiry Committee to take no further action in the investigation of a complaint has the right to request the Board of the College to review that decision.

A request for review must be made within 14 days of the day the complainant receives notice of the decision of the Inquiry Committee.

There is no right for the complainant or the respondent to make submissions to the Board on such a review. On a review, the Board carefully examines the decision of the Inquiry Committee and all of the documents that were before the Inquiry Committee when it made its decision.

Upon completion of its review the Board may confirm the inquiry committee’s decision, or direct the inquiry committee to act under one of the following sections of the Health Professions Act: section 33 (6), section 36, or section 37.

Discipline Committee Appeals

A respondent, or the College, may, within 30 days, appeal a decision of the Discipline Committee to the Supreme Court of British Columbia.

Registration Committee Appeals

An applicant for registration may, within 30 days, appeal a decision to grant registration to the Supreme Court of British Columbia.
